Buyer love letters are a huge NO-NO in the real estate world due to potential Fair Housing Act violations. The National Fair Housing Act prohibits discrimination in housing and lending based on race, color, religion, sex, disability, familial status and National origin. The state of Colorado’s fair housing law is even more expansive, adding protected classes of ancestry, creed, marital status, sexual orientation and source of income.
As a seller, accepting an offer with a love letter containing a simple phrase like “We can’t wait to see our children come down the stairs on Christmas morning in your home.” can get you into some hot legal hot water. This phrase alone identifies a buyer’s religion and familial status. If you base any part of your offer acceptance on the fact that you preferred one buyer over the next because you were made aware of certain information about the buyers, you are putting yourself at risk.
