Let’s talk about compensation paid on seller paid costs.
First, let me clarify, compensation is and always has been, a negotiable item in real estate. With the recent NAR buyer agency compensation settlement, buyers and sellers alike need to understand how compensation is paid and on what dollar amount.
Real estate contracts to list and purchase homes in the state of Colorado outline that compensation is based on “The final sales price of a home”.
Let’s look at an example. If you’re a seller and agree to pay $10,000 towards a buyer’s closing costs or rate buy down, the contracts you sign state you will be paying compensation on the final sales price including any “seller paid” items for a buyer. According to the contract, you will be paying compensation on the $10,000 you’ve agreed to pay to the buyer.
Maybe this sits alright with you. Maybe not.
